PROCLAMATION
RE: SHELLFISH POLLUTED AREA

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Leah Devlin, D.D.S., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following closure in shellfish harvesting area will take effect immediately:

The following change is a closure to shellfish harvesting:

ORIENTAL AREA (F-5) – Map 20

River Dunes Marina – All those waters in the River Dunes Marina Basin upstream of a line beginning at a point 35º 05.3130' N -76º 36.3525' W on the shore north of the entrance canal; running northwesterly to a point 35º 05.3195' N -76º 36.3670' W in Broad Creek; running southwesterly to a point 35º 05.2687' N -76º 36.4007' W in Broad Creek; running southeasterly to a point 35º 05.2613' N -76º 36.3841' W on the shore south of the entrance canal.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. This amends N.C. Marine Fisheries Proclamation PA-PC-2006 (20) by the addition of (20) (e) and closes approximately 28 acres.

D. This closure is due to a recent sanitary survey of the Oriental area of Pamlico County.
