PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Leah Devlin, D.D.S., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Thursday, October 25, 2007.

The following area in Brunswick County will be opened to shellfishing on a temporary basis:

BRUNSWICK COUNTY:

Lockwoods Folly River - All those waters in Lockwoods Folly River bordered on the south by a straight line beginning at a point 33º 55.9854' N -78º 13.1539' W on the west shore of the river north of Genoes Point; running easterly to a point 33º 56.0606' N -78º 12.4035' W on the east shore of the river; and bordered on the north by a line beginning at a point 33º 56.3730' N -78º 13.2443' W on the west shore of the river near Myrtle Point; running easterly to a point 33º 56.3036' N -78º 12.7741' W on the east shore of the river south of Mullet Creek (see map).

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. This proclamation temporarily opens a portion of Lockwoods Folly River.

D. This temporary opening is due to satisfactory bacteriological sampling results of both water and shellfish meats.
