PROCLAMATION
RE: SHELLFISH POLLUTED AREA

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Leah Devlin, D.D.S., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following openings in shellfish harvesting area will take effect at sunrise, Thursday, November 15, 2007.

The new closure description for the Mill Creek area is as follows:

MILL CREEK AREA (C-1) – Map 41

Swan Point Marina / New River Marina – All those waters within Swan Point Marina and New River Marina and extending beyond the dockage facilities 325 feet from Swan Point Marina and 200 feet from New River Marina beginning at a point 34º 32.7234' N -77º 21.6661' W on the shore west of Swan Point Marina; running northerly to a point 34º 32.7852' N -77º 21.6649' W; running easterly to a point 34º 32.7834' N -77º 21.5354' W; running southerly to a point 34º 32.5351' N -77º 21.5400' W; running westerly to a point 34º 32.5365' N -77º 21.6362' W on the shore south of New River Marina.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. This amends N.C. Marine Fisheries Proclamation PA-PC-2006, (41) (e) and opens approximately 4 acres.

D. These openings are due to recent sanitary surveys in the Mill Creek area of Onslow County.
