Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Leah Devlin, D.D.S., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area closures will take effect immediately: No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas: The following changes are closures to shellfish harvesting: WRIGHTSVILLE BEACH AREA (B-7) – Map 44 Shinn Point – All those waters bordered on the east by a line beginning at a point 34º 11.5089' N -77º 49.6846' W north of Shinn Point; running easterly to a point 34º 11.4973' N -77º 49.6538' W; running southwesterly to a point 34º 11.4183' N -77º 49.6977' W; running northwesterly to a point 34º 11.4403' N -77º 49.7557' W; running southwesterly to a point 34º 11.3335' N -77º 49.8554' W on the shore south of Shinn Point. g) Mason Landing Yacht Club – All those waters within Mason Landing Yacht Club and extending beyond the dockage facilities 325 feet beginning at a point 34º 15.8951' N -77º 46.2913' W on the north shore; running southeasterly to a point 34º 15.8323' N -77º 46.2098' W; running southwesterly to a point 34º 15.7835' N -77º 46.2560' W; running northwesterly to a point 34° 15.7914’ N -77° 46.2699’ W on the south shore. GENERAL INFORMATION: A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0101. B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103. C. This proclamation supersedes maps and descriptions from PA-PC-2006, dated December 18, 2006. D. This proclamation amends N.C. Marine Fisheries Proclamation PA-PC-2006, Maps (44) (d), (44) (g) and (44) (h) and closes approximately 35 acres; Maps (43) (a), (43) (b), (43) (e) and by the addition of (43) (n) and closes approximately 131 acres; Map (36) by the addition of (36) (d) and closes approximately 1 acre; Map (29) and closes approximately 427 acres; and also amends Map (44) (f) and does not result in any additional closures. E. These closures are due to recent sanitary surveys in the Wrightsville Beach area of New Hanover County, the Topsail Sound area of Pender County, the Queens Creek area of Onslow County and a hydrographic study of the Taylors Creek area of Carteret County.
