PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Leah Devlin, D.D.S., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Friday, December 14, 2007.

The following areas in Carteret County will be opened to shellfishing on a temporary basis:

CARTERET COUNTY

NORTH RIVER AREA:

Wards Creek – All those waters in Wards Creek upstream of the Ward Creek Bridge (see map).

North River – All those waters in North River above the North River Bridge up to a straight line beginning at a point on the west shore at 34° 48.3965’ N -76° 37.3219’ W; running easterly across the river to a point on the east shore at 34° 48.4727’ N -76° 37.0699’ W (see map).

NEWPORT RIVER AREA:

Harlowe Creek - All those waters in Harlowe Creek downstream of a straight line beginning at a point on the west shore at 34° 47.4060’ N -76° 43.3689’ W; running easterly across the creek in a straight line to a point 34° 47.4190’ N -76° 43.3237’ W on the east shore (see map).

Newport River - All those waters in Newport River bounded on the west by a straight line beginning at a point on the north shore at 34° 45.8045’ N -76° 45.2811’ W; running southerly to a point on the south shore at 34° 43.2780’ N -76° 44.0700’ W and bounded on the east by a straight line beginning at a point on the north shore at 34° 46.0253’ N -76° 45.0627’ W; running southeasterly in a straight line to a point on the south shore at 34° 45.5461’ N -76° 44.1308’ W (see map).

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. These temporary openings are due to satisfactory bacteriological sampling results of both water and shellfish meats.
