PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Jeffrey P. Engel, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Tuesday, December 15, 2009.

All those waters in Onslow and Carteret Counties will return to the status in existence immediately prior to the November 11, 2009 and December 3, 2009 temporary closures with the following exceptions, which will remain closed:

ONSLOW / CARTERET COUNTIES

New River - All those waters upstream of a line beginning on the north shore of New River at Grey Point, running southeasterly to a point on the south shore of New River north of Goose Creek.

All those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by the Surf City Bridge.

Queens Creek – All those waters in Queens Creek upstream of a straight line across the mouth.

All those waters from the ICWW to mainland between Fl.Beacon 25 & Channel Marker #27 near Broad Ck.

Newport River - All those waters upstream of a line across the river beginning at a point on the south shore at Lawton Point; thence to a point on the north shore just upstream of Hammock Rock (see map).

Long Bay – All those waters in Long Bay upstream of a straight line from the north shore of Fur Creek running easterly to Swimming Point.

The following also remains closed:

BRUNSWICK / PENDER COUNTIES

Shallotte River - All those waters in Shallotte River upstream of a straight line from Bowen Point to Long Point.

All those waters from the ICWW to the mainland between the Surf City Bridge and Fl. Beacon #96 near Topsail Creek.

All those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by the Surf City Bridge.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: Onslow Beach Bridge area; ICWW to the mainland between ICWW Fl. Beacons #55 and #49, except Queens Creek; White Oak River; a portion of Bogue Sound; a portion of Newport River; North River; and Whitehurst Creek.

D. These reopenings are due to satisfactory bacteriological sampling results.
