PA-95-2009 PROCLAMATION Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Jeffrey P. Engel, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area temporary closures will take effect immediately: No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas: DARE, HYDE, PAMLICO, BEAUFORT, CARTERET, ONSLOW, PENDER, NEW HANOVER AND BRUNSWICK COUNTIES All those waters 200 yards offshore, on the sound side, between the north side of Ocracoke Inlet and the south side of Oregon Inlet. All those waters north and west of a line beginning at Long Shoal Point thence in a straight line To Long Point; thence in a straight line to the northernmost tip of Hog Island; thence in a straight line to Bluff Point; thence in a straight line to Juniper Bay Point on the east shore of Juniper Bay; thence in a straight line to the southernmost point of Great Island Marsh; thence in a straight line to Shell Point on the west shore of Swanquarter Bay; thence in a straight line to Sow Island Point on the north shore of Jones Bay; to include all of Juniper Bay, Swanquarter Bay, Pungo River, Pamlico River, Spencer Bay, Rose Bay, West Bluff Bay, East Bluff Bay, Wysocking Bay and Long Shoal River and all other tributaries within said boundaries. All those waters south and west of a line beginning at a point on the eastern end of Sow Island Point on the north shore of Jones Bay; thence in a straight line to the northeastern end of Maw Point near the mouth of Bay River; thence in a straight line to the north end of Point of Marsh; thence in a straight line to a point on the northwestern shore of North Bay; to include all of Jones Bay, Bay River, Neuse River, West Bay, North Bay and all other tributaries within said boundaries. Cedar Island Bay – All those waters in Cedar Island Bay upstream of a straight line beginning at Hog Island Point thence across the bay to Long Point, to include Lewis Creek. All those waters bordered on the east and south by a line beginning at Long Point near Rumley Bay thence in a straight line to Lookout Point on the east shore of Thorofare Bay, thence in a straight line across Thorofare Bay to Hall Point near Atlantic, thence in a straight line to Fl. Beacon #20 in Core Sound, thence in a straight line to Fl. Beacon #27 in Core Sound, thence in a straight line to Fl. Beacon #37 in Core Sound, thence in a straight line to Shell Point on Harkers Island, thence in a straight line across Back Sound to a point on Shackleford Banks near Banks Bay to the South Carolina State Line; to include all of Thorofare Bay, Rumley Bay, Barry Bay, Styron Bay, Nelson Bay, Fulchers Creek, Brett Bay, Oyster Creek, Bells Creek, Tusk Creek, Middens Creek, Jarrett Bay, The Straits, North River, Back Sound; Carrot Island, Newport River, Bogue Sound, White Oak River, Queens Creek, Bear Creek, New River, Stump Sound, Topsail Sound, Myrtle Grove, Masonboro Sound, The Basin, Buzzards Bay, Cape Fear River, Lockwoods Folly River, Shallotte River and all other tributaries within said boundaries. GENERAL INFORMATION: A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03K .0101. B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103. C. These temporary closures are due to extremely heavy rainfall and resultant runoff associated with Hurricane Ida. |
