PROCLAMATION

RE: SHRIMPING AND CRAB TRAWLING

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 5:00 P.M., Sunday, June 5 , 2011 shrimping and crab trawling will be allowed in the following areas. This proclamation brings together in one document all areas that are NOW OPEN until changed by subsequent proclamations or newly effective rules.

I. AREA DESCRIPTIONS - NORTHERN AND CENTRAL DISTRICTS:

A. ATLANTIC OCEAN - except inside the hook at Cape Lookout

B. ROANOKE SOUND/CROATAN SOUND - The line separating Croatan and Roanoke sounds from Albemarle Sound is described as a line beginning on Long Point at 36° 02.4910’N – 75° 44.2140’W; running southerly to a point on Roanoke Island 35° 56.3302’N – 75° 43.1409’W; running northwesterly to Caroon Point 35° 57.2255’N – 75° 48.3324’W.

1. Shallowbag Bay – east of the special secondary nursery area line described in NCAC 03R .0105 (1) (a). (Map 1)

Bogue Sound - except that area on the north side of the Intracoastal Waterway from Marker #7 to Guthrie Point and the area bounded by a line beginning at Intracoastal Waterway Marker #31; running southerly to a point on Long Island 34° 40.9000’ N – 76° 58.6666’ W; running westerly to a point on Piney Island 34° 40.8666’ N – 77° 00.6500’ W; running westerly to a point 34° 41.1666’ N – 77° 00.7000’ W on the spoil island near Green Flasher #37; running in a northeasterly direction along the south side of the spoil islands to the point of beginning. Archers and Hoop Pole creeks, Pine Knoll Shores Canal, Coral Bay and Tar Landing Bay are closed to trawling across their mouths. (Map 10)

II. GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-182; 113-170.4; 113-170.5; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 03H .0103; 03J .0104; 3L .0101 and .0202.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103.

C. It is unlawful to use any bottom disturbing fishing gear on any shellfish lease or franchise unless it has been duly authorized by the Fisheries Director according to Marine Fisheries Rules15A NCAC 03O .0211 and in accordance with Marine Fisheries Rule15A NCAC 03O .0204(f), the Division has no duty to protect any shellfish bottom lease, franchise, or water column lease not marked according to 15A NCAC 03O .0204(a).

D. As specified in the Blue Crab FMP, Marine Fisheries Rule 15A NCAC 03J .0104(b)(6) prohibits trawls in designated pot areas opened to the use of pots by 15A NCAC 03J .0301 (a)(2) and bound by the shoreline to the depth of six feet as described in the initial subparagraphs of 15A NCAC 03R .0107(a)(5), (a)(6), and (a)(7).

E. Hatched and blackened areas on the attached maps indicate those areas closed to shrimping and trawling except as noted in II.H.

F. The Division of Marine Fisheries will mark the areas to be opened with signs insofar as may be practical. No unauthorized removal or relocation of any such sign shall have the effect of changing the area opened, nor shall any such unauthorized removal or relocation or the absence of any sign affect the applicability of this proclamation. Where there is conflict between signs and maps, maps shall prevail.

G. Proclamation SH-3-2001, dated May 22, 2001, describes required Bycatch Reduction Devices (BRDs) to be used in shrimp trawls. Section III.D. of Proclamation FF-55-2010(REVISED), dated May 21, 2010 limits the amount of weakfish (100 pounds) that can be taken with shrimp or crab trawls.

H. N.C. Marine Fisheries Rule 15A NCAC O3L .0103 (c) describes the areas in which it is unlawful to use trawls with a combined headrope length greater than 90 feet (mouths of the Neuse and Pamlico rivers and all of Bay River). Rule 15A NCAC O3R .0114 describes the lines in Pamlico, Pungo and Neuse rivers above which shrimp trawls are prohibited. Crab trawling, however, is still permitted in those areas.
