RE: RED DRUM

 

Preston P. Pate, Jr.,  Director, Division of Marine Fisheries, hereby announces that effective at 8:00 A.M., Thursday, November 22, 2001, the following will apply:

 

RED DRUM – PROCLAMATION FF-34-98, dated December 30, 1998 IS RESCINDED.  Proclamation FF-34-98 established a January through December commercial fishing season. That season has been superseded by N.C. Marine Fisheries Rule 3M .0501(f), which sets a September 1 through August 31 season.  The 100 pound commercial trip limit has been superseded and the applicable proclamation is FF-47-2001, dated September 4, 2001, which sets a seven (7) red drum per day limit.

 

GENERAL INFORMATION

 

A.    This proclamation is issued under the authority of G.S. 113-182; 113-170.4; 113-170.5; 113-221(e); 143B-289.52; and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3M .0504.

 

B.    It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority per 15A NCAC 3H .0103.

 

C.       The purpose of this proclamation is to rescind the proclamation listed above.  Since the rule, approved subsequent to the proclamation, nullifies the provisions of the proclamation, it is rescinded.
