PROCLAMATION

                                                                                                   PT-4-2001

RE:     CRAB, EEL, FISH AND SHRIMP POTS

 

Preston P. Pate, Jr., Director, Division of Marine Fisheries, hereby announces that effective at 12:01 A.M., Monday, May 1, 2001 until midnight, October 31, 2001, the following will apply to crab, eel, fish, and shrimp pots:

 

POTS MAY BE SET IN THE FOLLOWING AREAS:

I.  WYSOCKING BAY - HYDE COUNTY:     

 

A.   Bound by a line beginning at a point on the south shore of Lone Tree Creek 35E 25' 05" N - 76E 02' 05" W running 239E (M) 1000 yards to a point 35E 24' 46" N - 76E 02' 32" W; thence 336E (M) 2200 yards to a point 35E 25' 42" N - 76E 03' 16" W; thence 062E (M) 750 yards to a point on shore 35E 25' 54" N - 76E 02' 54" W; thence following the shoreline and the Lone Tree Creek primary nursery area line to the beginning point (See Map 1 - Area 1).

 

B.   Bound by a line beginning at a point on the south shore of Mt. Pleasant Bay 35E 23' 07" N - 76E 04' 12" W running 083E (M) 1200 yards to a point 35E 23' 17" N - 76E 03' 32" W; thence 023E (M) 2400 yards to a point 35E 24' 27" N - 76E 03' 12" W; thence 299E (M) 1100 yards to a point on shore 35E 24' 38" N - 76E 04' 48" W: thence following the shoreline and the Browns Island and Mt. Pleasant Bay Primary nursery area line to the beginning point; except pots may be set no more than 50 yards from the shoreline (See Map 1 - Area 2).

 

II. JUNIPER BAY - HYDE COUNTY:  

 

Bound by a line beginning at a point on Juniper Bay Point 35E 20' 18" N - 76E 13' 22" W running 275E (M) 2300 yards to a point 35E 20' 15" N - 76E 14' 45" W; thence 007E (M) 2100 yards to Daymarker No. 3; thence 040E (M) 1100 yards to a point on shore 35E 21' 45" N - 76E 14' 24" W; thence following the shoreline and the Buck Creek primary nursery area line to the beginning point (See Map 1 - Area 3).

 

III.      ROSE BAY - HYDE COUNTY:

 

Bound by a line beginning at a point southwest of Swan Point 35E 23' 56" N - 76E 23' 39" W running 288E (M) 1500 yard to a point 35E 24' 03" N - 76E 24' 33" W; thence 162E (M) 1650 yards to a point 35E 23' 19" N - 76E 24' 04" W; thence 084E (M) 1350 yards to a point on shore 35E 23' 29" N - 76E 23' 17" W; thence following the shoreline to the beginning point (See Map 2 - Area 4).

 

IV.      SPENCER BAY - HYDE COUNTY:

 

Bound by a line beginning at a point on shore at Willow Point 35E 22' 26" N - 76E 28' 00" W running 059E (M) 1700 yards to a point  35E 22' 57" N - 76E 27' 13" W ; thence 317E (M) 1500 yards to a point 35E 23' 25" N - 76E 27' 57" W; thence 243E (M) 1300 yards to a point on shore 35E 23' 02" N - 76E 28' 35" W; thence following the shoreline to the beginning point (See Map 2 - Area 5).


 

V.   NEUSE RIVER - PAMLICO COUNTY: 

 

A.   Beginning at a point on shore north of Swan Creek 35E 07' 17" N - 76E 33' 26" W running 115E (M) to a point near the six foot depth contour 35E 07' 15" N - 76E 33' 16" W; thence running 074E (M) to Beacon No. 2 at Maw Point Shoal; thence running 294E (M) to a point on shore 35E 08' 30" N - 76E 32' 36" W; thence following the shoreline to the beginning point (See Map 3 - Area 6).

 

B.   Beginning at a point on shore north of Gum Thicket Creek 35E 04' 40" N - 76E 35' 38" W; thence running 129E (M) to a point 35E 04' 12" N - 76E 34' 37" W; thence running 355E (M) to Beacon No. 1 in Broad Creek; thence running the six foot contour line to Green Marker No. 3 (See Map 3 - Area 7).

 

C.   Beginning at a point on the eastern tip of Cockle Point 35E 03' 20" N - 76E 38' 27" W; thence running 100E (M) to a point 35E 03' 18" N - 76E 37' 53" W; thence running 005E (M) to a point on shore 35E 03' 38" N - 76E 37' 54" W; thence following the primary nursery area line to the beginning point (See Map 3 - Area 8).

 

VI.  GENERAL INFORMATION:

 

A.   This proclamation is issued under the authority of G.S. 113-182; 113-221(e); 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H.0103 and 3J.0301 (a) (2) (B).

 

B.   It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority per 15A NCAC 3H.0103.

 

C.   The intent of this proclamation is to allow pots to be set in long haul seining areas currently not being used.

 

D.   Hatched  areas on attached maps indicate those areas designated for pots by rule 15A NCAC 3R .0107; shaded areas indicate areas opened to pots by proclamation authorized in 15A NCAC 3J .0301 (a) (2) (B).  White areas on Map #2, near Marsh Point, Deep Cove and Caffee Bay are ALWAYS CLOSED to potting.

 

E.   This proclamation expires at midnight, October 31, 2001 unless superseded by another proclamation.
