PROCLAMATION

 

RE: SHELLFISH MANAGEMENT AREAS

 

Preston P. Pate, Jr., Director, Division of Marine Fisheries, hereby announces that effective at sunrise, Monday, October 15, 2001, the following Shellfish Management Areas will open to the taking of oysters, but remain closed to the taking of clams:

 

BRUNSWICK COUNTY

 

1.      That portion of Old Channel OMA as shown on Map #1.

 

2.      That portion of Sheep Island OMA as shown on Map #2.

 

NEW HANOVER COUNTY

 

1.   That portion of Back Channel OMA shown on attached Map # 3.

 

2.   Those portions of Bird=s Nest OMA and South Figure Eight OMA as shown on Map #4.

 

PENDER COUNTY

 

1.   That portion of Hunter=s OMA as shown on attached Map # 4. 

 

GENERAL INFORMATION:

 

a)   This proclamation is issued under the authority of G.S. 113-182; 113-221(e); 143B-289.52 and implementing N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0103.

 

b)   It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority per 15A NCAC 3H .0103.

 

      c)   The Division of Marine Fisheries will mark the affected areas with signs insofar

as may be practicable.  No unauthorized removal or relocation of any such sign

 

 

 

 

shall have the effect of changing, nor shall any such sign affect the applicability of any proclamation or portion thereof.  Where there is conflict between signs and maps, maps shall prevail.

 

d)         These areas affected by this proclamation will be marked with orange signs stating AOyster Management Area - Closed to Clamming.@

 

e)         Hatched areas on the attached maps indicate areas open to oystering and closed to the taking of clams.
