PROCLAMATION

RE: PORBEAGLE SHARKS-COMMERCIAL FISHING OPERATIONS- ATLANTIC OCEAN

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 11:30 P.M., Saturday, September 4, 2010 the following will apply to the harvest of sharks for commercial purposes in the Atlantic Ocean waters of North Carolina:

I. SEASON CLOSURE

It is unlawful to possess, sell or offer for sale porbeagle sharks taken with commercial fishing equipment or for commercial purposes in the Atlantic Ocean.

The remainder of the Pelagic category (shortfin mako, thresher, oceanic whitetip, and blue shark) are not effected by this closure.

II. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03M.0512.

B. It is unlawful to violate the provisions of any proclamation issued by the Director under his delegated authority pursuant to N.C. Fisheries Rule 15A NCAC 03H .0103.

C. The quota established by the National Marine Fisheries Service and the Atlantic States Marine Fisheries Commission (ASMFC) Interstate Fisheries Management Plan for Atlantic Coastal Sharks has been met. The closure will remain in effect until the effective date of the final 2011 shark season specifications that will be published in the Federal Register.
