PROCLAMATION

RE: ARTIFICIAL REEF COMMERCIAL FISHING EQUIPMENT

Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 8:00 A.M., Wednesday, November 24, 2010, the following restrictions will apply:

I. AREA DESCRIPTION

BRUNSWICK COUNTY

In the Atlantic Ocean within 500 yards of the center marking buoy of the Yaupon Beach Artificial Reef (AR 425) off Brunswick County. The location of the buoy is 33° 53.0500’N- 78° 06.5670’ W.

II. GEAR RESTRICTIONS

It is unlawful to use gill nets or trawls in the area of the Yaupon Beach Artificial Reef (AR 425) described above.

III. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03I .0109.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant N.C. Marine Fisheries Rule 15A NCAC 03H .0103.

C. The intent of this proclamation is to avoid interactions such as recent ones between commercial fishing gear and artificial reef materials. N.C. Marine Fisheries Rule 15A NCAC 03I .0109 specifies that the restrictions shall be in effect until November 24, 2011, subject to renewal by the Director.
