PROCLAMATION

RE: SHELLFISH MANAGEMENT AREA

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that the following Shellfish Management Areas will open to the taking of oysters and clams by hand or hand tongs effective at sunrise, Friday, October 15, 2010:

I. AREA DESCRIPTION

ONSLOW COUNTY

ALL SHELLFISH MANAGEMENT AREAS IN NEW RIVER AND ALLIGATOR BAY
WITH THE FOLLOWING EXCEPTIONS:

Alligator Bay (CF), Everett’s Bay, and Traps Bay Oyster Management Areas- The North Carolina Coastal Federation’s cultch/monitoring sites located on the southwest side of Trap’s Bay, (attached Map #1) Alligator Bay and the northeast side of Everett’s Bay (attached Map #2) shall remained closed to the taking of clams and oysters. These areas are shown as the hatched area on the attached maps.

II. GENERAL INFORMATION

A. This proclamation is issued under the authority of G.S. 113-182; 113-221; 143B-289.52 and implementing N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03K .0103.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority per 15A NCAC 03H .0103.

C. These openings will be in effect when re-opened by the Shellfish Sanitation Section of the NC Division of Environmental Health.

D. The Management Areas in New River and Alligator Bay will close to the taking of clams upon the closing of oyster season in 2011.
