PROCLAMATION

RE: 2010 SHRIMP AND CRAB TRAWLING

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that the following areas SHALL OPEN to shrimp and crab trawling effective 12:00 Noon, Saturday, October 2, 2010:

I. AREAS: CARTERET COUNTY

D. East Thorofare Bay-Barry Bay - See Map
E. Cedar Island Bay See Map
F. Long Bay - Ditch BaySee Map
G. West Thorofare BaySee Map
H. Turnagain BaySee Map

II. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 181; 113-182; 113-221.1; 143B-289.52 and Marine Fisheries Rules 15A NCAC 03H .0103, 03L .0101, 03L .0202, and 03N .0105.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to Marine Fisheries Rule 15A NCAC 03H .0103.

C. This action will allow the harvest of pink and white shrimp prior to the onset of cooler winter temperatures and reduced availability of shrimp in the affected areas.

D. Marine Fisheries Rule 15A NCAC 03O .0211 provides that it is unlawful to use any bottom disturbing fishing gear on any shellfish lease or franchise unless it has been duly authorized by the Fisheries Director. Also, pursuant to Marine Fisheries Rule 15A NCAC 03O .0204(f), the Division has no duty to protect any shellfish bottom lease, franchise, or water column lease not marked in accordance to 15A NCAC 3O .0204(a).

E. Hatched areas on the attached maps indicate areas closed to shrimp and crab trawling.

F. This proclamation supersedes the portions of Proclamation SH-5-2010, dated June 2, 2010 and SH-11-2010, dated September 9, 2010 that pertain to the affected areas. The special secondary nursery areas listed above will close pursuant to Marine Fisheries Rule 15A NCAC 03N .0105.
