PROCLAMATION

 

 

RE:  SHRIMPING AND CRAB TRAWLING                                                

 

Preston P. Pate, Jr., Director, Division of Marine Fisheries, hereby announces that effective 7:15 P.M., Sunday, June 2, 2002, this proclamation supersedes all proclamations affecting shrimping and crab trawling (except Section III. C. of Proclamation FF-29-2000, Proclamation M-9-97, and Proclamation SH-2-2002) north of Bogue Inlet issued prior to June 2, 2002 and brings together in one document all areas that will remain open until further notice:

 

A.     NORTHERN AND CENTRAL DISTRICTS:

 

1.   Atlantic Ocean - except inside Athe hook@ at Cape Lookout

 

2. Roanoke Sound/Croatan Sound

a.    Shallowbag Bay (Map 1)

b.   Broad Creek (Map 1)

c.   Kitty Hawk Bay (Map 1)

d.    Colington Creek (Map 1)

e.    Buzzard Bay (Map 1)

 

3.   Pamlico Sound

a.      Eastern Pamlico Sound (Maps 8 and 9)

b.      Western Pamlico Sound (Maps 2 and 3)

c.   West Bay – north of a line beginning at a point on the west shore at 35° 02’ 03”N-76° 26’ 06’W, running east through Markers “A”, “4WB”, and “5WB” to a point on the east shore at 35° 02’ 06”N-76°21’ 52”W. (Map 8)

4.      Rose Bay/Spencer Bay – south of a line beginning at a point on Willow Point 35° 22’22”N- 76° 27’ 52”W, running southeasterly to a point on Judith Island 35° 21’ 54”N- 76° 32’ 24”W. (Maps 3&4) 

    5.    Swanquarter/Juniper Bay – south of a line beginning at Shell Point on Swanquarter Island at           35°19’ 52”N-76° 22’ 28”W, running southeasterly to a point on Great Island at 35° 18’ 27”N-76°16’           02”W; then south of a line from the point on Great Island running northeasterly to a point on                Juniper Bay Point at 35° 20’ 17”N-76° 13’ 21”W. 6.   Pungo River - All tributaries will remain closed. Satterthwaite and Wright creeks open to Inland boundaries. (Map 4)

 

7.   Pamlico River (Maps 4 & 5)

9.      Neuse River – north and east of a line from Point of Marsh to Maw Point. (Map 6)

 

 

 

10.  Core Sound - except those areas as shown on Maps 8 and 10.

 

a.      Rumley Bay - south of a line beginning at a point 34E 55' 47" N - 76E 17' 04" W; thence running

      050E M to a point 34E 56' 11" N - 76E 17' 11" W.  (Map 8)

 

b.      Thorofare Bay - Barry Bay - east of a line beginning at a point on Hall Point 34E 54' 27" N - 76E 18' 49" W, running 048E (M) to a point at Lookout Point 34E 55' 24" N - 76E 17' 48"W. (Map 8)

11.  Back Sound - except that area bound by a line beginning at a point east of the Cape Lookout Channel 34E 40' 18" N - 76E 30' 14" W, running 292E M through Green Flasher #35 at Shell Point to Green Flasher #3 in the Harkers Island Channel located 34E 41' 18" N - 76E 33' 51" W; thence 202E (M) to a point on the south shore 34E 39' 55" N - 76E 34' 18" W.  (Map 10)

 

12.    Beaufort Inlet Area:

 

a.   North River - south of a line beginning at a point on the west shore at 34E 46' 02.3" N - 76E 37' 03.8" W, running 079E 58' 01" TRUE to a point on the east shore at 34E 46' 16.0" N - 76E 35' 29.6" W.  Pilings along this line represent the true line.  (Map 11)

 

b.      Wards Creek - west of a line beginning on the south shore on the impoundment bulkhead at 34° 45' 27.1" N - 76° 35' 10.6" W, running 342° 15' 08" TRUE to a point on the north shore at 34° 46' 16.0" N - 76° 35' 29.6" W.  Pilings along this line represent the true line. (Map 11)

 

c.      Newport River - east of a line beginning near Penn Point on the south shore at 34E 45' 41.8" N - 76E 43' 31.1" W; running 39E 43' 22" TRUE to a point on the north shore near Hardesty Farms Subdivision=s boat ramp at 34E 46' 34.4" N - 76E 42' 38.1" W. Pilings along this line represent the true line. (Map 11)

 

d.   Core Creek (Map 11)

 

13.   Bogue Sound - except that area on the north side of the Intracoastal Waterway from Marker #7 to Guthrie Point and the area bounded by a line beginning at Intracoastal Waterway Marker #31

      running 200E M to a point on Long Island 34E 40' 54" N - 76E 58' 40" W; thence 272E M to a point       on Piney Island 34E 40' 52" N - 77E 00' 39" W; thence 354E M to a point 34E 41' 10" N - 77E 00'       42"W on the spoil island near Green Flasher #37; thence in a northeasterly direction along the        south side of the spoil islands to the point of beginning.  Archers and Hoop Pole creeks, Pine           Knoll Shores Canal, Coral Bay and Tar Landing Bay are closed to trawling across their mouths.       (Map 12)

 

 

 

 

B.     GENERAL INFORMATION:

 

1.       This proclamation is issued under the authority of G.S. 113-182; 113-170.4; 113-170.5; 113-221(e);

       143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H .0103; 3J .0104; 3L .0101 and .0202.

 

2.    It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority per 15A NCAC 3H .0103.

 

3.    It is unlawful to use any bottom disturbing fishing gear on any shellfish lease or franchise unless it has been duly authorized by the Fisheries Director according to 15A NCAC 3O .0211 and according to 15A NCAC 3O .0204(f), the Division has no duty to protect any shellfish bottom lease, franchise, or water column lease not marked according to 15A NCAC 3O .0204(a).

 

4.    Hatched and blackened areas on the attached maps indicate those areas closed to shrimping and crab trawling.

 

5.       The Division of Marine Fisheries will mark the areas to be opened with signs insofar as may be

practical.  No unauthorized removal or relocation of any such sign shall have the effect of changing the area opened, nor shall any such unauthorized removal or relocation or the absence of any sign affect the applicability of this proclamation.  Where there is conflict between signs and maps, maps shall prevail.             

 

6.      Proclamation SH-3-2001, dated May 22, 2001, describes required Bycatch Reduction Devices (BRDs) to be used in shrimp trawls.
