PROCLAMATION

 

RE:  SHELLFISH MANAGEMENT AREA

 

      Preston P. Pate, Jr., Director, Division of Marine Fisheries, hereby announces that effective at 8:00 A.M., Wednesday, October 15, 2003, the following areas are declared SHELLFISH MANAGEMENT AREAS and ARE CLOSED to the use of trawl nets, long haul seines, swipe nets, rakes, dredges and to the harvest of all shellfish:

 

I.         DARE COUNTY

 

A.            CROATAN SOUND - An area located 1.0 nautical miles west of Channel Marker #1 at the southern end of Roanoke Island as shown on Map 1.  The area is delineated by Artificial Reef Buoys.   The locations of the buoys are as follows:

 

                     1.                     NE Corner                     35° 48.2842’ N                     75° 38.3360’ W

                     2.                     NW Corner                     35° 48.2842’ N                     75° 38.4575’ W

                     3.                     SE Corner                     35° 48.1918’ N                     75° 38.3360’ W

                     4.                     SW Corner                     35° 48.1918’ N                     75° 38.4575’ W

 

      B.   CRAB HOLE - An area as shown on Map 1.  The area is delineated by Artificial Reef Buoys.  The locations of the buoys are as follows:

      C.   CLAM SHOAL - An area as shown on Map 2.  The area is delineated by Artificial Reef Buoys.  The locations of the buoys are as follows:

II.    HYDE COUNTY

 

DEEP BAY - An area located 0.5 nautical miles northwest of Channel Marker #2 as shown on Map 1.  The area is delineated by Artificial Reef Buoys.  The locations of the buoys are as follows:

 

                     1.                     NW Corner                     35° 22.9125’ N                     76° 22.3377’ W

                     2.                     NE Corner                     35° 22.9126’ N                     76° 22.1612’ W

                     3.                     SW Corner                     35° 22.7717’ N                     76° 22.3377’ W

III.   CARTERET COUNTY

 

WEST BAY - An area located 1.3 nautical miles east of Tump Island as shown on Map 2.  The area is delineated by Artificial Reef Buoys.  The locations of the posts are as follows:

 

               1.      NE Corner      34° 58.8517’ N      76° 21.3632’ W

               2.      NW Corner      35° 58.8517’ N      76° 21.4734’ W

               3.      SE Corner      35° 58.7661’ N      76° 21.3632’ W

               4.      SW Corner      36° 58.7661’ N      76° 21.4735’ W

 

IV.  GENERAL INFORMATION:

 

      A)   This proclamation is issued under the authority of G.S. 113-170.4; 113-170.5; 113-182; 113-221(e); 143B-289.52; and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0103.

 

      B)   It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority per 15A NCAC 3H .0103.

 

      C)   The shellfish management areas have been designated to enhance oyster growth and reproduction under protected conditions which should benefit oyster production in these areas.

 

      D)   The Division of Marine Fisheries will mark the affected areas with buoys indicating ‘ARTIFICIAL REEF” insofar as may be practicable.  No unauthorized removal or relocation of any such buoy shall have the effect of changing, nor shall any such buoy affect the applicability of any proclamation or portion thereof.  Where there is conflict between buoys and maps, maps shall prevail.

     

      E)   This proclamation supersedes SF-6-2003, dated October 6, 2003.   Specific closure restrictions were added for clarification and Clam Shoal was has been placed in Dare County.
