PROCLAMATION

RE: - GILL NETS - BOGUE BANKS

Preston P. Pate, Jr., Director, Division of Marine Fisheries, hereby announces that effective at 12:01 P.M., Saturday, September 8, 2006, the following restrictions shall apply to the gill net fishery off eastern Bogue Banks:

I. AREA

Gill net requirements in this proclamation apply only in the Atlantic Ocean off the eastern end of Bogue Banks within 350 feet of the ocean beach west of 76° 42.0653’W (Fort Macon State Park) and east of 76° 44.5351’W (Raleigh Street).

II. SEASON

Gill net restrictions shall apply from 12:01 P.M., Friday, September 8, 2006 through 6:00 P.M., Sunday, November 15, 2006 and shall end at that time by this proclamation.

III. NET RESTRICTIONS

A. Only gill nets with a maximum length not exceeding 160 yards may be used.

No stationary gill nets shall be used in a zone 200 yards wide beginning at a point 150 yards from the beach at mean low water and extending offshore in a southerly direction.

No gill nets may be set within 750 feet of an ocean fishing pier.

No gill nets may be set within 450 yards east of a deployed stop net, as measured from where both nets connect with the shore.

IV. GENERAL INFORMATION

A. This proclamation is issued under the authority of G.S. 113.170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and Marine Fisheries Rules 15A NCAC 3H .0103, and 3J .0103.

B. It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to Marine Fisheries Rule 15A NCAC 3H .0103.

C. The intent of this proclamation is to address user conflicts in the described area during the peak fall fishing season.
