SF- 6- 2006 RE: SHELLFISH POLLUTED AREA Preston P. Pate, Director, Division of Marine Fisheries, upon the recommendation of Leah Devlin, M.P.H., Interim State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area openings will take effect at sunrise, Sunday, October 15, 2006: I. AREA DESCRIPTIONS: BRUNSWICK COUNTY A. The “Jay” Rock Oyster Management Area (also known as the lower Crossrock OMA) shown on the attached map. That portion of the Drum Slough Oyster Management Area shown on the attached map. A. This proclamation is issued under the authority of the N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0101. B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103. C. The Division of Marine Fisheries will mark the affected areas with signs insofar as may be practicable. No unauthorized removal or relocation of any such sign shall have the effect of changing, nor shall any such sign affect the applicability of any proclamation or portion thereof. Where there is conflict between signs and maps, maps shall prevail. D. These areas affected by this proclamation will be marked with orange signs stating Oyster Management Area - Closed to Clamming. E. Hatched areas on the attached map indicate areas open to oystering and closed to the taking of clams. October 4, 2006 |
