PROCLAMATION

RE: FLOUNDER-COMMERCIAL HARVEST INTERNAL COASTAL WATERS

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 6:00 P.M., Friday, December 14, 2007, the following restrictions shall apply to the commercial harvest of flounder in internal coastal waters:

AREA DESCRIPTION

Internal coastal waters of the state of North Carolina as defined in Marine Fisheries Rule 15A NCAC 3I .0101 (b) (10).

SEASON CLOSURE

In the area described above, it is unlawful to possess, land, sell or offer for sale flounder in a commercial fishing operation from 6:00 P.M., Friday, December 14, 2007 through December 31, 2007, except dealers will have until 6:00 P.M. on December 21, 2007 to sell, offer for sale, transport or have in possession unfrozen flounder taken in this fishery prior to the closure.

GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and Marine Fisheries Rules 15A NCAC 3H .0103 and 3M .0503.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. The possession and sale of live flounder in tanks or pools that were captured and recorded on N.C. trip tickets prior to 6:00 P.M. on December 14, 2007 is permitted during the season closure.

D. This proclamation delays implementation of the December 1 closure provision of the Southern Flounder Fishery Management Plan due to multiple significant variable conditions.

E. The prohibition of the use of gill nets with a mesh length of greater than 4 ¼ inches (stretched mesh) in the Pamlico Sound Gill Net Restricted Area in Proclamation M-19-2007, dated November 13, 2007 remains in effect through December 15 and is not superseded.
