PROCLAMATION

RE: CHANNEL NETS

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 10:30 A.M., Saturday, December 8, 2007, the following will apply to the setting of channel nets in coastal fishing waters:

I. SUSPENSION OF PORTION OF MARINE FISHERIES RULE 15A NCAC 3J .0106

The following portion of N.C. Fisheries Rules for Coastal Waters 15A NCAC 3J .0106 that deal with channel nets in coastal fishing waters is suspended:

Section (c), which reads:
It is unlawful to leave any channel net, channel net buoy, or channel net stakes in coastal fishing waters from December 1 through March 1.

B. The suspension of this rule ends at 12:01 A.M. on Tuesday, January 1, 2008. Channel nets, buoys and stakes shall be removed from the coastal fishing waters by that time.

II. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H .0103, 3 I .0102 and 3J .0106.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. The intent of this proclamation is to delay the implementation of the requirement to remove channel nets, buoys and stakes from coastal fishing waters through December 31, 2007 to allow the harvest of white shrimp still present in the area.
