PROCLAMATION

re: Coastal Recreational Fishing License Exemption Permit

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective 12:01 A.M., Thursday, June 14, 2007, the following requirements shall be met to obtain a permit for exemption from recreational fishing license requirements:

COASTAL RECREATIONAL FISHING LICENSE EXEMPTION PERMIT REQUIREMENTS

It is unlawful for the responsible party seeking exemption from recreational fishing license requirements for eligible individuals to conduct an organized fishing event held in coastal or joint fishing waters without first obtaining a Coastal Recreational Fishing License Exemption Permit.

The Coastal Recreational Fishing License Exemption Permit shall only be issued for recreational fishing activity conducted solely for the participation and benefit of the following eligible individuals:

1. Individuals with physical or mental limitations; or
2. Members of the United States Armed Forces and their dependents, upon
presentation of a valid military identification card, for military appreciation; or
3. Individuals receiving instruction on recreational fishing techniques and conservation
practices from:

b. Employees of state or federal agencies; or
c. Instructors affiliated with educational institutions.

The Coastal Recreational Fishing License Exemption Permit shall be valid for the date(s), time and physical location of the organized fishing event for which the exemption is granted and the time period shall not exceed one year from the date of issuance.

The Coastal Recreational Fishing License Exemption Permit shall only be issued when all of the following information, in addition to the information required in 15A NCAC 03O .0501, is submitted to the Fisheries Director in writing a minimum of thirty days prior to the event:

1. The name, date(s), time and physical location of the event.
2. Documentation that substantiates local, state or federal involvement in the organized fishing event, if applicable.
The cost or requirements, if any, for an individual to participate in the event; and
An estimate of participants.

II. GENERAL INFORMATION

A. This proclamation is issued under authority of N.C. G.S. 113-170.4, 113-170.5, 113-182, 113-221.1, 143B-289.52 and N.C. Fisheries Rules 15A NCAC 3H .0103, and 3O .0506.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to the N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. The intent of this proclamation is to implement a Coastal Recreational Fishing License Exemption Permit in accordance with N.C.G.S. 143B-289.52. Tournaments holding the Recreational Fishing Tournament License to Sell Fish License are not eligible for this Permit.

D. The Coastal Recreational Fishing License Exemption Permit will be issued by the Division of Marine Fisheries at no cost.

E. Permit procedures and requirements as specified in N.C. Marine Fisheries Rule15A NCAC 03O .0501, .0502 and .0504 apply to the Coastal Recreational Fishing License Exemption Permit.

F. This proclamation supersedes Proclamation M-18-2006, dated December 13, 2006. It does not affect any previously issued CRFL Exemption Permits.
