RS-10-2007 PROCLAMATION RE: RESEARCH SANCTUARY Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 12:00 P.M., Monday, September 17, 2007, the following area will be declared a RESEARCH SANCTUARY, and close to the taking of shellfish: I. AREA DESCRIPTION: NEW HANOVER COUNTY In Dick’s Bay between the ICW and Masonboro Island, and north of Carolina Beach Inlet. The area is approximately 3.7 acres in size and is delineated by four pilings and signs as shown on the attached map. The location of the pilings are as follows: 1. 34º 05.6918N 77º 52.3578W A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3I .0109. B. It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries 15A NCAC 3H .0103. C. These areas will be used by the North Carolina Coastal Federation and UNCW to conduct research on oyster larvae/spat growth and survival. D. N.C. Marine Fisheries Rule 15A NCAC 3I .0109, specifies that these Research Sanctuaries are in effect for one year, subject to renewal at the end of that year.
