PROCLAMATION

RE: RESEARCH SANCTUARY

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 8:00 A.M., Thursday, September 20, 2007, the following area is declared a RESEARCH SANCTUARY and IS CLOSED to all fishing equipment until 12:01 AM January 1, 2008:

I. AREA DESCRIPTION:

CARTERET COUNTY - Back Sound, Middle Marsh (IMS RS 11 on the attached map)

An area consisting of approximately 0.20 acres on the southwest end of Middle Marsh as shown on the attached map. The area is delineated as described below.

An area within 50 feet of a stake located at 34° 41.372’ N – 76° 37.110’ W.

II. GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3I .0109.

B. It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. Stakes and signs posted by the applicant will mark the area closed to fish and shellfish harvest.

D. This action is being taken to allow the UNC Institute of Marine Sciences to conduct research for bay scallop restoration.
