PROCLAMATION

RE: RESEARCH SANCTUARY

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at sunrise, Tuesday, July 24, 2007 the following areas are designated Research Sanctuaries and will close to the taking of oysters and clams and to the use of trawls:

I. AREA DESCRIPTION

CARTERET COUNTY
The areas are delineated by four pilings and signs as shown on the attached map. The locations of the pilings are as follows:

Newport River Area
1. 34° 46.4754’N 76° 42.1781’W
2. 34° 46.4316’N 76° 42.1882’W
3. 34° 46.3993’N 76° 42. 0818’W
4. 34° 46.4451’N 76° 42.0710’W

North River Area
1. 34° 46.8000’N 76° 36.5000’W
2. 34° 46.7000’N 76° 36.5000’W
3. 34° 46.7000’N 76° 36.4000’W
4. 34° 46.8000’N 76° 36.4000’W

II. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52; and Marine Fisheries Rules 15A NCAC 3H .0103 and 3I .0109.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. This proclamation establishes two Research Sanctuaries so that the plantings can be monitored for long-term structural integrity without the effects of harvest.
